General Terms and Conditions of Use

1. Introduction
  • Prince OH Collection (“we,” “our,” or “us”) operates an e-commerce marketplace consisting of a website and mobile application (“Marketplace”) together with supporting IT, logistics, and payment infrastructure for the sale and purchase of consumer goods and services (“Products”) within Nigeria (“Territory”).
  • These General Terms and Conditions (“Terms”) apply to all buyers (“you,” “your,” or “User”) who use our Marketplace and shall govern your use of our website, mobile application, and related services.
  • By accessing or using our Marketplace, you agree to be bound by these Terms in full. If you do not accept any part of these Terms, you must not use our Marketplace.
  • If you use the Marketplace on behalf of a company or organization, you represent and warrant that you are authorized to bind that entity to these Terms.
2. Registration and Account

  • By confirming a purchase on the Marketplace, you enter a binding contract with the relevant seller for the listed product(s).
  • Product prices and applicable taxes are clearly displayed in each product listing. Additional charges such as delivery fees shall be communicated before checkout.
  • Payments must be made through approved third-party payment gateways such as Paystack or Flutterwave. By using these services, you agree to their respective terms and privacy policies.
4. Delivery, Returns, and Refunds
  • Delivery timelines are estimated and depend on product availability, location, and courier efficiency.
  • Returns and refunds shall be handled in accordance with our Returns and Refund Policy, which forms part of these Terms.
  • Refunds may be made through the original payment method, store credit, or any other method we deem appropriate.
  • Certain items, including perishable goods, personal-care products, or digital downloads, may not be eligible for return.
5. Use of the Marketplace

You may use the Marketplace only for lawful purposes and in accordance with these Terms.

You agree not to:

  • engage in any fraudulent, abusive, or misleading activity;
  • attempt to gain unauthorized access to our systems;

  • By submitting content, you grant Prince OH Collection a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for marketing or operational purposes.
  • We reserve the right to remove any content that violates these Terms or applicable laws.

  • We process your personal data in accordance with our Privacy Policy and the Nigeria Data Protection Act (NDPA) 2023.
  • By using the Marketplace, you consent to such processing, including data sharing with trusted partners such as payment gateways and logistics providers strictly for transaction purposes.
9. Limitation of Liability

To the fullest extent permitted by law, Prince OH Collection shall not be liable for any:

  • indirect, incidental, or consequential damages;
  • loss of profits, revenue, or data; or
  • delay or failure caused by events beyond our reasonable control.

Our total aggregate liability in respect of any claim arising from your use of the Marketplace shall not exceed the total amount paid for the product giving rise to such claim.

10. Indemnification

You agree to indemnify and hold harmless Prince OH Collection, its directors, employees, and affiliates from any claims, losses, damages, or expenses arising from your breach of these Terms or misuse of the Marketplace.

11. Termination

We may suspend or terminate your access to the Marketplace at any time if you violate these Terms or engage in any activity that could harm the platform or its users.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

We may update or revise these Terms from time to time. Updated versions will be posted on our website, and continued use of the Marketplace after such changes constitutes your acceptance of the revised Terms.
